தமிழகத்தில் பத்திரப்பதிவு துறையால் வழங்கப்படும் ஆவணங்களில் மாற்றங்களை செய்து பலர் மோசடியில் தொடர்ந்து ஈடுபட்டு வருகிறார்கள்.. இதனால் இவைகளுக்கெல்லாம் ஒரு கடிவாளம் போடவே, இந்த முயற்சி எடுக்கப்பட்டுள்ளது..குறிப்பாக, திருமணம், சொத்து உள்ளிட்ட பதிவு சான்றிதழ்களை திருத்த இயலாத அளவிற்கு நிரந்தர ஆவணங்களாக மாற்ற தகவல் தொழில்நுட்பத் துறை சார்பில் நம்பிக்கை இணையம் என்ற தொழில்நுட்பம் கொண்டு வரப்பட்டது.

திருத்த முடியாது: மின்னணுமயமாக்கப்பட்ட ஆவணங்கள் முத்திரையிடுவதை நோக்கமாக கொண்டு செயல்படுவதால், இதனை முன் தேதியிட்டு மாற்றவோ அல்லது திருத்தவோ முடியாது. அதுமட்டுமல்லாமல், ஒளி வருடல் செய்யப்பட்ட ஆவணங்களை சேமிப்பதன் மூலம் மெய் தன்மை உறுதி செய்யப்படும். இப்போது, ஆவணங்கள் அனைத்திலும் 1-5-2023-க்கு பிறகு பதிவு செய்யப்பட்ட நம்பிக்கை இணையம் ஏற்படுத்தப்பட்டுள்ளது.

ஒருவரிடம் நிலம் உரிமையாகி இருக்கின்றது என்றால் இரண்டு ஆவணங்கள் முக்கியமாக இருத்தல் வேண்டும்.


ஒன்று பத்திரம்(SALE DEED ),
இன்னொன்று பட்டா( PATTA ).

பத்திரம் – பதிவுத்துறை சார்ந்த ஆவணம்,

பட்டா – வருவாய்த்துறை சார்ந்த ஆவணம்.

நிலம் ஒரு நபரின் பெயரில் இருக்கும் பட்டா வேறொரு நபரின் பெயரில் இருக்கும் !
நம் நாட்டில் பெண் பிள்ளைகளுக்கும் குடும்ப சொத்தில் பங்கு இருக்கிறது என்று உச்ச நீதிமன்றம் கூறிய தீர்ப்பின் அடிப்படையில் நிலங்கள் பிரிக்கப்படுவதில் இப்பொழுது பல்வேறு சிக்கல்கள் இருக்கிறது.

குறிப்பாக நிலம் ஒரு நபரின் பெயரில் இருக்கும் பட்டா வேறொரு நபரின் பெயரில் இருக்கும் இதற்கு சரியான தீர்வு என்னவென்று தெரிந்து கொள்ள முடியாது.
ஒவ்வொரு நபரும் ஒவ்வொரு விதமான தகவல்களை கொடுத்து உங்களை குழப்பி விடுவார்கள்.

பட்டா சிட்டா என்றால் என்ன
பட்டா என்பது ஒரு நிலம் இவர் பெயரில்தான் உள்ளது என்பதை குறிக்கும் வகையில் வருவாய் துறையால் அளிக்கப்படும் ஒரு சான்று.

அதாவது பட்டா என்பது நில உரிமை ஆவணம் என்று சொல்லப்படுகிறது, அந்த பட்டாவில் யார் பெயர் இருக்கிறதோ, அவரே தற்போதைய நில உரிமையாளர் ஆவார்
.
பட்டா ஆவணத்தில் மாநிலம், மாவட்டம், வட்டம், கிராமம், நிலத்தின் சர்வே எண், என்ன வகையான நிலம், விரித்தொகை எவ்வளவு, இடத்தின் விஸ்திரம், உரிமையாளர் பெயர் மற்றும் அவரின் தந்தையின் பெயர் ஆகியவை அடங்கியிருக்கும்.

பத்திரம் என்பது ஒரு சட்டபூர்வமான ஆவணம் இது நிலம் வைத்திருக்கும் நபர் குறிப்பிட்ட நிபந்தனைகளை பூர்த்தி செய்வதால், சொத்துக்களுக்கான சில உரிமைகளை வைத்திருப்பவருக்கு இந்த ஆவணம் வழங்குகிறது.

பொதுவாக சொத்து அல்லது வாகனத்தின் உரிமையை மற்றொரு நபருக்கு மாற்றுவதற்கு பத்திரங்கள் பயன்படுத்தப்படுகிறது.
பட்ட முக்கியமா அல்லது பத்திரம் முக்கியமாஎன்ற கேள்வி மக்களிடத்தில் எப்பொழுதும் இருக்கிறது.
என்னிடம் பட்டா இருக்கிறது ஆனால் பத்திரம் இல்லை என்னிடம் பத்திரப்பதிவு இருக்கிறது ஆனால் பட்டா இல்லை இதற்கு சரியான தீர்வு என்ன.

உச்சநீதிமன்றம் வெளியிட்ட அடிப்படையில் பட்டா என்பது உரிமை ,பத்திரம் தான் முக்கியம் என்றும் 
பட்டா தேவை இல்லை என்று கூறியுள்ளது.
பத்திரம் தான் வருவாய் ஆவணங்களுக்கான ஆதாரமாக இருக்கிறது, ஒரு பத்திரத்தின் அடிப்படையில் தான் பட்டா வழங்கப்படுகிறது. அதனால் தான் பத்திரப்பதிவு துறையில் பத்திரம் பதிவதில் அசல் ஆவணங்கள் இல்லாமல் பல முறைகேடுகள் நடந்துள்ளதாக பல புகார்கள் பல வழக்குகள் நீதிமன்றத்தில் நிலுவையில் உள்ளது குறிப்பிடத்தக்கது.

பத்திரம் மட்டும் இருக்கும் நிலம் புறம்போக்கு நிலம் என்று சொல்லலாம், அந்த நிலத்தை அரசாங்கம் கையகப்படுத்தினால் ஒன்றும் செய்ய முடியாது.
ஆனால் பட்டா இருக்கின்ற நிலம் சட்டபூர்வமான நிலம் ஆகும் அதை அரசாங்கம் கையகப்படுத்தினாலும் அதற்கு நஷ்ட ஈடு கொடுக்க வேண்டும்.
அதனால் நிலம் இருக்கிறது என்றால் அதற்கு பட்டாவும் முக்கியம் பத்திரப்பதிவு முக்கியம்.
வில்லங்கச் சான்று என்றால் என்ன
வில்லங்கச் சான்றிதழ் என்பது நமது தமிழக அரசு 1975 ஆம் ஆண்டு ஜனவரி 1ம் தேதி முதல் நேற்று வரை அந்த நிலத்தை பற்றிய தகவலாகும்.
குறிப்பாக நீங்கள் ஒரு நிலம் வாங்கு முயற்சி செய்கிறீர்கள் என்றால் அந்த நிலத்தின் சர்வே எண் வைத்து வில்லங்கச் சான்று எடுத்து பார்த்தால் அந்த நிலம் எத்தனை நபர்களுக்கு விற்பனை செய்யப்பட்டுள்ளது.
யார் பெயரில் இருக்கிறது அந்த நிலத்தில் ஏதேனும் பிரச்சனைகள் இருக்கிறதா அந்த நிலத்திற்கு யார் ஏதேனும் மறைமுகமாக உரிமை கோர முடியுமா.
அந்த நிலத்திற்கு வாரிசு இருக்கிறதா, வாரிசு இல்லையா அல்லது தூரத்து ரத்த சொந்தம், வாரிசு இருக்கிறதா என்பதை பற்றி முழுமையாக தெரிந்து கொள்ளலாம்.
நீங்கள் நிலத்திற்கு பாதுகாப்பு வேண்டுமென்றால் இந்த வில்லங்கச் சான்று எடுத்து பார்த்துக் கொள்ளலாம்.
அடங்கல் என்றால் என்ன
அடங்கல் என்பது நம் தமிழக அரசால் வழங்கப்படும் ஒரு நிலத்திற்கான சான்றிதழ் குறிப்பாக நிலம் நன்செய் நிலமா,புன்செய் நிலமா மானாவரி நிலமா என்று குறிக்கும்.

அந்த நிலத்தின் மண்ணிற்கு ஏற்ப என்ன வகையான பயிர்கள் செய்யப்படுகிறது,என்பதை குறிக்கும், இதை வைத்து நீங்கள் தமிழக அரசிடம் வேளாண் கடன்களை பெற முடியும்.

வரைபடம் என்றால் என்ன
நிலத்திற்கான வரைபடம் என்பது உங்களுடைய நிலம் எவ்வளவு உள்ளது, சதுர வடிவில் உள்ளதா, வட்ட வடிவில் உள்ளதா, நீள் வட்ட வடிவில் உள்ளதா,செவ்வக வடிவில் உள்ளதா, உங்கள் நிலத்தை சுற்றி யாருடைய சொத்துக்கள் இருக்கிறது, என்ன சர்வே எண் இருக்கிறது, என்பதை தெளிவாகக் குறிக்கும்.கட்டாயம் பதிவு செய்ய வேண்டிய பத்திரங்கள்…..

இந்திய பதிவுச் சட்டம் 1908 (The Indian Registration Act 1908) என்பது பிரிட்டீஸ் அரசு கொண்டு வந்து, இந்திய அரசு ஏற்றுக் கொண்ட ஒரு சட்டம்; இதில் “இந்திய” என்ற வார்த்தையை 1969ல் இருந்து நீக்கி விட்டார்கள்; (இந்தியாவில் இருக்கும் சட்டங்கள் எல்லாமே இந்தியச் சட்டங்கள் தானே!); இந்த பதிவுச் சட்டத்தில்தான், பத்திரங்களை பதிவு செய்யவதைப் பற்றிய சட்ட விபரங்கள் சொல்லப்பட்டுள்ளன.


இந்த பதிவுச் சட்டத்தின் பிரிவு 17(1)ன்படி சில பத்திரங்களை கட்டாயம் பதிவு செய்து கொள்ள வேண்டும் என்று சொல்லப்பட்டுள்ளது; அவ்வாறு “கட்டாயம் பதிவு செய்ய வேண்டும்” என்று சொல்லி உள்ள பத்திரங்களை, பதிவு செய்யாமல் விட்டுவிட்டால், அவைகள் சட்டப்படி செல்லாது; அந்த பத்திரங்களைக் கொண்டு உரிமை கோர முடியாது; கோர்ட்டில் அந்த பத்திரங்களை ஒரு சாட்சியமாக (Documentary evidence) எடுத்துக் கொள்ள முடியாது.

பொதுவாக அசையாச் சொத்துக்களை (Immovable properties) பதிவு செய்து கொள்ள வேண்டும்; ஆனால் அதிலும் குறிப்பாக சில பத்திரங்களை கட்டாயப் பதிவில் சேர்த்துள்ளார்கள்.

கட்டாயமாகப் பதிவு செய்து கொள்ள வேண்டிய பத்திரங்களின் விபரம்….

(1) அசையாச் சொத்தின் “தானப் பத்திரம்” (Gift deed) எழுதிக் கொடுத்தால், அதை கட்டாயமாகப் பதிவு செய்து கொள்ள வேண்டும்.

(2) அசையாச் சொத்தில் உள்ள சொத்துரிமையை மாற்றிக் கொடுத்தாலும், விற்பனை செய்தாலும், விட்டுக் கொடுத்தாலும், விடுதலை செய்தாலும், அந்தப் பத்திரங்களை கட்டாயமாக பதிவு செய்து கொள்ள வேண்டும். அவ்வாறு கொடுக்கும் உரிமை அன்றே இருந்தாலும், பின்
ஒருநாளில், அதாவது இனிமேல் தருகிறேன் என்று சொல்லி இருந்தாலும் அதையும் கட்டாயமாகப் பதிவு செய்து கொள்ள வேண்டும்.

(3) அசையாச் சொத்தில் உள்ள உரிமையை விட்டுக்கொடுப்பதற்காக பணம் பெற்றுக் கொண்டால், அந்தப் பத்திரங்களை கட்டாயமாகப் பதிவு செய்து கொள்ள வேண்டும்.

(4) வருடக் குத்தகைப் பத்திரங்கள் (Yearly Leases) கட்டாயமாகப் பதிவு செய்து கொள்ள வேண்டும். வருடக் குத்தகை என்பது ஒரு வருடம் அல்லது அதற்குமேல் உள்ள காலத்துக்கு குத்தகை ஒப்பந்தம் செய்து கொள்வது. (நகரங்களில் உள்ள வீட்டு வாடகைகள், பொதுவாக மாத வாடகையாக 11 மாதங்களுக்கே செய்து கொள்ளப்படும். எனவே வீட்டு வாடகை பத்திரங்கள் பதிவு செய்ய வேண்டிய அவசியம் இருக்காது.

(5) அசையாச் சொத்துக்களைப் பொறுத்துப் பெறப்பட்ட கோர்ட் டிகிரிகள், கோர்ட் உத்தரவுகள், அவார்டுகள், இவைகளை அல்லது அந்த டிகிரியை வேறு ஒருவருக்கு மாற்றிக் கொடுக்கும் அசைன்மெண்ட் பத்திரங்களை (Assignment of Degree, Order or Award) கட்டாயமாகப் பதிவு செய்து கொள்ள வேண்டும்.

(6) அடுக்குமாடிக் கட்டிடங்களை தனி ப்ளாட்டுகளாக கட்டிக் கொடுக்கச் செய்து கொள்ளும் ஒப்பந்தங்களை (Agreement relating to construction of multiunit house building on land) கண்டிப்பாக பதிவு செய்து கொள்ள வேண்டும்.

மேற்சொன்னவை அல்லாமல் மற்ற பத்திரங்களை கட்டாயம் பதிவு செய்து கொள்ள வேண்டிய அவசியம் ஏதும் இல்லை.

அதைப்பற்றிய விபரம் கீழே…

(1) சில ஏற்பாடுகளைச் செய்து கொள்ளும் பத்திரங்கள்.

(2) கம்பெனிகளின் ஷேர்களின் பத்திரங்கள் (Shares relating to Joint Stock Company).

(3) கம்பெனிகள் கொடுக்கும் டிபன்சர் பத்திரங்கள் (Debenture issued by company).

(4) கம்பெனி டிபசன்பர் பத்திரங்களை மாற்றிக் கொடுக்கும் பத்திரங்கள்.

(5) அசையாச் சொத்தின் எந்த உரிமையையும் மாற்றிக் கொடுக்காத பத்திரங்கள்.

(6) கோர்ட் டிகிரிகள், கோர்ட் உத்தரவுகள், any Degree or Order of a Court; இவைகளை பதிவு செய்து கொள்ள வேண்டிய அவசியம் இல்லை. (ஆனால், அந்த வழக்கில் சம்மந்தப்படாத அசையாச் சொத்தைப் பொறுத்த அந்த கோர்ட் ஒரு டிகிரி கொடுத்திருந்தால், அதை கண்டிப்பாக பதிவு செய்து கொள்ள வேண்டும்.

அதாவது, வழக்கில் அந்த அசையாச் சொத்து சம்மந்தப்பட்டிருந்தால், அந்த டிகிரியை பதிவு செய்து கொள்ள வேண்டிய அவசியம் இல்லை. வழக்குக்கு சம்மந்தமில்லாத வேறு ஒரு அசையாச் சொத்தைப் பொறுத்து, பார்ட்டிகளுக்குள் சமாதான டிகிரியை கோர்ட் மூலம் பெற்றிருந்தால், அந்த கோர்ட் டிகிரியை கண்டிப்பாக பதிவு செய்து கொள்ள வேண்டும்).

(7) அரசாங்கம் எழுதிக் கொடுக்கும் அசையாச் சொத்துக்களின் கிராண்ட் பத்திரங்களை (Government Grant) பதிவு செய்து கொள்ள வேண்டிய அவசியம் இல்லை. (அரசாங்கம் விற்கும் அல்லது இலவசமாக கொடுக்கும் அசையாச் சொத்தின் பத்திரங்களை பதிவு செய்து கொள்ள வேண்டும் என்ற கட்டாயம் இல்லை.

(8) நில மேம்பாட்டுச் சட்டம் 1871ன்படி கொடுக்கும் கொலேட்டிரல் செக்யூரிட்டி கடன் பத்திரங்களை பதிவு செய்ய வேண்டிய கட்டாயம் இல்லை.

(9) விவசாய கடன் சட்டம் 1884ன்படி கொடுக்கும் கடன் பத்திரங்களை பதிவு செய்ய வேண்டிய கட்டாயம் இல்லை.

(10) அறக்கட்டளை சட்டம் 1890ன்படி அதில் உள்ள ஒரு டிரஸ்டி, அந்த டிரஸ்ட்டின் சொத்தை வேறு ஒரு டிரஸ்டிக்கு பொறுப்பு ஒப்படைக்கும் பத்திரத்தை பதிவு செய்து கொள்ள வேண்டிய கட்டாயம் இல்லை.

(11) ஒரு அடமானப் பத்திரத்தில் பெற்ற அடமானக் கடனை, திருப்பி கொடுக்கும் ரசீது பத்திரத்தை, பதிவு செய்து கொள்ள வேண்டிய கட்டாயம் இல்லை. (ஆனாலும் அதை பதிவு செய்து கொண்டால், சொத்தின் வில்லங்க சான்றிதழிலேயே தெரிந்து கொள்ள வாய்ப்பாக இருக்கும்).

(12) கோர்ட் ஏலம் மூலம் விற்பனை செய்து, ஏலம் எடுத்தவருக்கு வழக்கும் கிரய சர்டிபிகேட் (Sale Certificate) என்னும் பத்திரத்தை பதிவு செய்து கொள்ள வேண்டிய கட்டாயம் இல்லை.

(ஆனாலும், வழக்கில் உள்ள பார்ட்டிகள் அந்த சொத்தை ஏலத்தில் விடுவதற்கு மனுச் செய்து அதன் மூலம் கோர்ட் ஏலம் கொண்டுவந்து விற்பனை செய்தால், அந்த விற்பனை பத்திரத்தை கண்டிப்பாக பதிவு செய்து கொள்ள வேண்டும். ஏனென்றால், அது கோர்ட்டே விற்பனை செய்த பத்திரம் அல்ல
